Hi, My tenant owes me rent, can i still take them to small claims court for unpaid rent if my company had been dissolved 1 month before the contract was signed. I forgot to amend the contract so the agreement they signed was between them and my dissolved company.
1. Who owns the property, your company (C) or you individually? 2. If you are the owner, the dissolution of C is not a problem- it was merely your agent. 3. But if C was the owner, you've big problems- its assets pass to the Crown. You'd have no further involvement or entitlement. So get specialist advice!
