FREE SECTION 8 NOTICE

How do landlords get a FREE section 8 Notice?

Landlords that are registered users of Property Hawk can download a Section 8 Notice for FREE. 

The free Section 8 Notice is available within Property Hawk’s free landlord software - Property Manager.

The Property Manager software will automatically fill in the Section 8 Notice form with all the relevant details.  It can then be viewed as a PDF, downloaded, emailed and printed off.  The form remains stored on the landlord’s account to be viewed or re-printed. 

When it comes to re-letting  to a subsequent tenant, a landlord just needs to create a new tenancy, a process that takes a couple of seconds,  a new Section 8 Notice form can then be generated and a landlord is then able to print off their new set of prescribed information.

Once a landlord has added their basic details by signing up, these are stored by the Property Manager and can be used to prepopulate a whole range of other forms needed by a landlord to manage their lettings business.

Using Property Manager to create your Section 8 Notice

Creating a section 8 Notice should take no longer than 3 minutes.  We have timed it! Having done it once it will take you even less time next time round.  The other good thing about using the Property Manager is that because it is Internet based you can use it at work……...when the boss isn’t looking!  A great time saving manoeuvre!

Which set of  prescribed information do I need?

The forms that a landlord will need to generate will depend on how the landlord intends to deal with the tenants deposit.  If the landlord is to use the custodial scheme they should download the custodial scheme information along with its terms and conditions.  Where a landlord is using the insurance backed scheme they should download the three parts relating to this scheme.

occupation required
Hi I am not sure weather to serve a section 8 notice or section 21 notice. The tenant has lived in the property for 2 years using a AST contract. I issued a new un signed by me contract to the tenant on about the 2/8/12 The last rent received was the 24/1/12 covering the period 28/1/12 to the 28/2/12, the tenant has advised me she cannot pay anymore money and has applied for council benefit which after speaking to the HB people she will not qualify for as she has no contract in force. The reason why I want this tenant out is she is 7 months pregnant and never advised me of this prior to me offering her a new tenancy. The property is shared with 3 other females and is highly unsuitable to have a baby living there. What is my best option please.

Hi

I have served a section 8 notice on grounds of rent arrears and irregular payment. I have gone over the schedule of payment that I attached this weekend and have noticed that he tenant owes £5,300 instead of £6950 as put in the notice. I delivered the notice on the 26 Sep however set it to expire on the 19 october to ensure that more than 2 weeks were given and I am now wondering if I should reserve a notice today or if I can amend it to ensure that the appropriate rent due is reflected (it is still substantially more than 2 months money owed)

rent arrears
My tenant moved into a flat i own on 24/8/12 he is paying weekly and paid 1st week in advance. Second week never turned up, 3rd week still no rent. Tenant had done some maintenance work at one of my other properties and agreed that the £200 i owed him i could have for the 2 weeks owed ie 31/8 and 7/9. ihave had no rent since then even though every time i speak to him he promises the rent will be paid 'tomorrow'. he is now 4 weeks in arrears and still no rent. What can i do as he still has a long way to go o a 6 month ast!

notice to serve
I have a tenant who is in a large amount of arrears. He is in a periodic contract it expired on the 26th October 2012. He has paid regular until March of this year. He has not made a single payment since then. Do i serve section 8 or 21. Please advise me ASAP>

This may be too late for you simi kaur but this is what you can do regarding your tenant situation.

As you have said periodic contract I have made the assumption you tenant has an assured tenancy. You can only serve a section 8 notice as he is in more than 2 months of arrears state mandatory ground 8-rent arrears in your notice. 2 weeks notice is needed.

However if your tenant has a assured shorthold tenancy you can serve either a section 8 notice giving your tenant 2 weeks notice or a section 21 notice, giving your tenant 2 months notice. No reason needs to be given with section 21 notices. But you would only serve this notice if you believe there is no hope in receiving the arrears.

Sect 8 notice
I have recently had a sect 8 claimed dismissed at court because I did not put the deposit in one of the gov backed schemes. I was under the impression that this only applied to sect 21 notices. Was the judge wrong, where is the case law in relation to a sect 8 notices as I cannot find it. She is way behind on her rent and owes me approx £9000.
